Tom Whitfield

Biography

Tom has over 20 years’ litigation experience. The main focus of his practice has been professional negligence claims in relation to claims brought against a broad range of professionals but in the main solicitors, accountants and surveyors.

He has also handled a large range of commercial disputes, which have included partnership and shareholder disputes, landlord and tenant matters, boundary disputes and contract claims.

Tom has significant experience of acting in specialist courts and is well versed in the use of various forms of ADR.

Tom’s background means that he has often come across circumstances when insurers have taken policy points refusing to meet their policyholders’ claims thereby avoiding cover. He is able to provide specialist advice on coverage to try to ensure that the insurer provides an indemnity under the policy.

Tom has a particular interest in disputes with insurers; he can provide advice on insurance policy wording or defend claims which are related an insured claim but which are uninsured. He is able act on defending any claims themselves whilst the issue of cover is in limbo or in circumstances where the insurer has legitimately declined cover.
