This event was very kindly chaired by David McIlroy of Forum Chambers and hosted by Nicole Blakey of Pennington Manches Cooper. Penningtons provided wonderful hospitality and a fantastic lunch at their offices in London. Drinks followed courtesy of Jamie Molloy of Ignite Specialty and Dominic Tucker of IDiscovery Solutions.
The space explored included the new Court of Appeal decision in Williams v Morris – a triumphant victory for Pennington Manches Cooper and speaker Simon Johnson of Enterprise Chambers –see here for an article by Enterprise Chambers – this secured a finding confirming over a century of case law that multiple claimants can issue proceedings in a single claim form.
David McIroy provided a powerful keynote address. He called for a strategic review of the affordability and insurability of professional negligence claims. He highlighted obstacles faced not only from funding, facing a period of uncertainty after PACCAR and the new proposed legislation, but also from procedural challenges to disclosure, witness statements, group litigation procedures as well as the application of the Manchester Building Society v Grant Thornton tests and the mounting challenge now facing professionals in the care they need to bring to the selection of their data providers.
Paul Marshall of Cornerstone Chambers provided a mesmerising update to the Post Office enquiry and his thoughts on the way the sub-postmasters have been treated in the background of the criminal and civil litigation that has taken place. Disclosure was a point mentioned arising from evidence presented at the enquiry the previous day, which he had attended, from Womble Bond Dickinson.
Philippa Hill of Grant Thornton provided her wise and insightful thoughts from her many years of experience as an expert on the culture of negligence and detection of fraud commenting on the auditors obligations and challenges and mentioning the HBOS Reading banking fraud compensation scheme.
Jamie Molloy of Ignite looked at the funding landscape from his direct funding experiences in group litigation and the wider market. He also commented on the impact of the PACCAR case to litigation funding and the new proposed legislation as well as the potential political opportunity to lobby for a return to recoverable ATE premiums as a potential solution.
Lloyd Maynard of Forum Chambers provided a vivid review of of key recent decisions notably looking at developments in deliberate concealment of evidence and the different ways that the Limitation Act sections can be interpreted.
Dominic Tucker of IDiscovery Solutions gave a different perspective of the disclosure issues raised in the Post Office enquiry, and commented that after the drama series and publicity for the first time he is finding people understand what his job is about. Dominic gave an example of a fake AI created video and the likely increasing challenges faced to assess what is genuine and what could be false evidence. He flagged up particularly the need for data from mobile phones, particularly chats like WhatsApp, to be preserved by all parties to potential litigation at an early stage alongside laptop and other computer evidence.

Booking conferences
- The full fee invoice for the conference ticket is payable.
- For conferences taking place at a venue on a fixed date, if cancellation is received in writing at least 21 working days before the event the fee will be credited less a £75 administration charge. Substitutions are welcome at any time subject to any variation in price that might be payable if the substitute is not entitled to a discount as a PNLA member or specialist.
- For virtual conferences the ticket(s) purchased are for the individual delegate(s) named in the booking. If a delegate gives access to the recorded speaker programme to others then they agree to pay for a ticket at the full fee for all those delegates who watch the programme deriving from such access.
- The booking constitutes a legally binding contract. The delegate and their employer/partnership/other practice entity are jointly and severally liable for payment of all the fees due.
- The PNLA and PNLA Training reserve the right without prior notice to vary or cancel an event where the occasion necessitates including changing the password for virtual conference programmes.
- The PNLA and PNLA Training accept no liability if, for whatever reason, the event does not take place or access online is not possible.
- Large print versions of the hand outs can be made available by prior request. If sufficient notice is not received, it will be provided as soon as possible after the event.
- If there are insufficient rooms in the hotel to accommodate all delegates who require one when an overnight stay is involved, we will try to arrange for rooms of a similar quality in a nearby hotel, but the organisers cannot be held responsible if such rooms are not available. Any additional cost will be invoiced to the delegate.
- To the extent permitted by law, it is agreed that the PNLA, PNLA Training Limited presenters and speakers will not be liable by reason of breach of contract, negligence or otherwise for any loss or consequential loss occasioned to any person acting, omitting to act or refraining from acting in reliance upon the course material or presentation of the event, or, except to the extent that any such loss does not exceed the price of the event, arising from or connected with any error or omission in the material or presentation of the event. Consequential loss shall be deemed to include, but not limited to, any loss of profits or anticipated profits, damage to reputation or goodwill, loss of business or anticipated business, damages, costs, expenses incurred or payable to any third party or any other indirect or consequential losses.
