Calling for evidence – Costs & Litigation Funding Survey – Civil Justice Council – Can you provide one example by 20 January 2025?

The CJC launched this consultation on 31 October 2024. It is clear they are linking both litigation funding and costs with a view to the progress of the Litigation Funding Bill and it must be inferred that they are looking beyond simply reversing PACCAR and into various aspects of access to justice for the future.

The Form CJC need by final deadline 31 January 2025

Evidence is critical to be listened to by the CJC Working Group and whilst we can all alone submit responses from anecdotal views – actual cases have been asked for by the group. The PNLA is therefore seeking information to create a table of evidence for reference to substantiate responses.

There are multiple questions being asked but the bottom line is as below if you can find a moment to respond for professional negligence & liability cases since 2012:

  1. Brief details of the size and nature of your professional negligence practice including location – would you liked to be named or not?
  2. Have you ever used Third Party Funding for one of your cases? If so please provide details of the type of case, nature of the party or parties – including groups – that you acted for as claimant or defendant, why TPF was necessary and how the numbers worked including if possible the value of the claim, costs of funding and costs of the parties in the litigation.
  3. Have you ever used After the Event Legal Expenses insurance? If so please provide the same details.
  4. Have you ever used other types of alternative funding eg Legal Aid, Before the Event legal Expenses insurance? if so please provide same details.
